My view relate to ˇ°tortˇ± and ˇ°infringementˇ±
Dear Sir, Below is about my view relating to ˇ°tortˇ± and ˇ°infringementˇ± Thank you.
I provide my personal understanding to the difference between "tort" and "infringement".
"Tort" is generally used in property law, especially refers to tangible property. The person(s) of this action shall bear the obligation of compensation of damages. In common law system, "infringement" is especially used in intellectual property laws. It means any action of entry of the "fringe" or scope of protection of an IP right. In common law, "tort" is never be used in IP field. So even though in Chinese the two words have no literal diversity at all, in English they are very different. I hope to receive other comments thereon. ˇˇ Sincerely yours, Dr. Johnson Wang Boss & Young ˇˇ Tel:00-86-10-84475588 Fax:00-86-10-84475686 email: wangzl@boss-young.com ˇˇ | |
